The Express Entry tie-breaking rule came into existence amidst the travel restrictions in the mid of March 2020. Express Entry is one of the most prominent pathways of Canadian immigration, specifically for foreign skilled workers.
IRCC brought forth a tie-breaking rule for Express Entry candidates to rank them under the Comprehensive Ranking System. Furthermore, this rule considers candidates based on the time and date of their profile submission in the Express Entry pool.
Post the introduction of this rule; it continues to apply for each Express Entry draw. Based on the Coordinated Universal Time, IRCC provided a list of standard cut-offs concerning the date and time. All the candidates receiving a score beyond the least CRS score for specific draws, along with those whose profile submission took place before the cut-off list, will receive an ITA. They will obtain an ITA for Canadian Permanent Residency under Express Entry.
Express Entry tie-breaking rule- a brief
The best example of this tie-breaking rule can be the Express Entry draw, which occurred on January 18, 2023. During this specific draw, IRCC provided 5,500 ITAs with the least CRS score of 490. Moreover, the department displayed the time and date regarding the tie-breaking rule on November 24, 2022.
Therefore, in such a situation, candidates with a CRS score of 490 or beyond, and in the event of prior submission of the profile, received ITAs.
Tie-breaking rule and its three key factors
Express Entry candidates will require to acknowledge the following vital factors even after the introduction of the Express Entry tie-breaking rule:
- The rule will not supersede a candidate’s CRS score– A candidate’s CRS score will be the chief determinant of ranking them against other aspiring and eligible Express Entry candidates. It is evident from its name that this rule only acts as a tie-breaker between candidates receiving an identical CRS score.
- A modified or updated profile won’t change the actual time of profile submission– Even though the candidates might update their Express Entry profile through an ECA or approved language outcome, their original submission time will not be influenced. Furthermore, it will remain constant.
- Creating a new profile or reapplying– There are situations when the original submission time will change. However, this will happen only in cases where the individual will be without identity, date, and time. Additionally, if a person deletes the profile before applying again at a later time or date, the first time he applied will differ from the timestamp of his reapplication.
