IRCCs new public policy offers OWP to sponsored family members.
Some sponsored spouses, partners, and dependent children will enter Canada as temporary residents to be with their sponsor while a family class sponsorship application is under processing. In the latter half of May, the IRCCs announcement on the temporary public policy enabled these people to work in Canada while the officials reviewed their applications.
IRCCs new public policy offers OWP to sponsored family members
This temporary public policy makes it easier for foreign people applying to live and work in Canada under family class sponsorship. It includes dependent children over the age of 18 to receive an Open Work Permit.
Now open to people applying from outside of Canada, these open work permits were previously exclusively available under the inland spousal sponsorship program.
According to the IRCC, giving open-work permits will support families’ capacity to fully integrate into their communities and maintain financial stability. Additionally, it will solve the nation’s labor shortages and the economy.
The eligibility requirements
Foreign nationals meeting either of the aforementioned requirements may receive an open work permit from IRCC officers. The foreign national must:
- Be a principal applicant who has submitted a family class application for permanent residence as a spouse, common-law partner, or conjugal partner and gained acceptance for processing by IRCC.
- Possess a work permit that is valid for a maximum of two years and has been applied for.
- Be the subject of a petition for sponsorship filed by their spouse, common-law partner, or conjugal partner who has Canadian citizenship or permanent residence.
- Hold the same Canadian residence as their sponsor at the time of application.
- Possess a current temporary residence visa for Canada or is eligible for and requested status restoration.
Alternative requirements
OR
- A dependent child who has been listed as an accompanying relative on a PR application.
- Has submitted a work permit application with a maximum two-year permit requested for its term.
- Possesses the identical Canadian residence as the major applicant and their sponsor at the time of application.
- Holds a valid Canadian temporary residence status, or the eligibility, and has already applied for the restoration status.
Family Unification Initiatives – Sean Fraser’s declaration
The enhancements that will boost family class immigration and family reunion in Canada became the topic of discussion by Sean Fraser on May 26. These steps consist of the following in addition to the new open work permit option:
- Reduced processing times for spousal applications for temporary residence visas (TRV).
- Newly developed processing methods specifically for spousal TRV candidates.
- Extensions for open work permit holders whose permits expire between August 1 and December 31, 2023.
He claimed that these actions mirror IRCCs commitment to family reunification and the significance of family reunification as a component of Canada’s immigration policy.
