Procedure to apply for Spousal work permit in Canada

Spouses and partners of applicants are granted permission to work in Canada while their applications for inland sponsorship are being processed. 

The ideal processing time of the IRCC for the applications for the Spousal Sponsorship Program claims to be a year. 

The IRCC allows applicants for an Open Work Permit to work while they await the decision regarding their application. 

This initiative can help spouses and partners to revive from financial and emotional crises. As one they do not have to wait to work till the decision of their application arrives. 

An open work permit does not bind the applicant to work for a specific employer or a specified job. The IRCC does not specifically demand an offer of employment from the applicant. The validity of this open work permit can be either as long as 2 years or the validity tenure of the passport. 

A candidate needs to fulfill all the criteria below in order to get an open work permit 

  • An application under the category of Spousal/Common-Law Partner Sponsorship Immigration Program has to be submitted for Canadian Permanent Residency. 
  • The residing address of the sponsor and the sponsored immigrant should be the same. 
  • The applicant should have the status of temporary resident which can be either under the category of international student, worker, etc. 
  • The sponsor and the sponsored applicant must fulfill all the eligibility requirements mentioned for the Spousal or common-law partner sponsorship.  

Applying for both sponsorship and open work permit is allowed in Canada. The applicant can first apply for the application of sponsorship and then the applicant can proceed with applying for the open work permit through online mode. 

The application for a work permit can only be processed by the IRCC only when the applicant possesses a valid status. The processing of the application only starts after the Canadian permanent residency application is approved.
