Specialized LMIA applications for Canadian employers

Specialized LMIA applications can significantly help Canadian employers hire Temporary Foreign Workers through the TFWP. It is compulsory for employers to submit a Labour Market Impact Assessment from ESDC.

Several exclusive LMIA applications are available for Canadian employers seeking to hire a foreign national worker. After obtaining the LMIA, they must also determine whether hiring a specific foreign worker will negatively impact the Canadian labor market or whether it will have a positive or neutral impact.

Additionally, there are a few specialized applications for the LMIA procedure, and one can use these based on specific requirements. These applications also have their eligibility, requirements, processing times, etc.

Specialized LMIA applications

You can access these applications based on the following conditions:

Express Entry

This application is exclusively for Canadian employers who wish to support the PR application of Temporary Foreign Workers. This application system allows employers to assist their employees in becoming temporary residents, provided they already legally reside in the country. As temporary residents, they can acquire one-year Canadian work experience. Eventually, they will also lead to permanent residence through the main streams under Express Entry. On the other hand, Quebec provides a separate system with different requirements and programs, such as the Quebec Experience Program.

Specialized LMIA applications- Global Talent Stream

The Global Talent Stream is an immigration program specific to skilled foreign workers with expertise in technological skills and the STEM field. These skilled workers must possess essentially required skills that are highly in demand but scarcely available. Such Temporary Foreign Workers tend to get high annual salaries of a minimum of $80,000 under NOC A or B. GTS also allows companies to apply for extended employment periods, up to three years. They will need to submit an LMIA and a Labour Market Benefits Plan. This plan will depict how the company will positively contribute to the growth of the Canadian labor market.

GTS also provides the following benefits for the additional paperwork:

  • Processing times will be faster with a service standard of ten business days. The Global Talent Stream usually meets this service standard at least 80 percent of the time.
  • Individuals can access personalized assistance throughout the process.
  • Additionally, highly skilled workers can also become eligible for faster processing times for their work permits. 80 percent of the time, the service standard remains successful.
  • Applicants also become eligible to add or change names on a positive GTS application. Also, the processing period will be from 15 to 20 business days on the application date.

Quebec system- specialized LMIA applications

Quebec’s system is entirely independent as it has the authority to govern economic immigration through the Regular Skilled Worker Program. Therefore, Quebec employers must submit an LMIA to Service Canada and the Quebec Immigration Ministry. Currently, Quebec prioritizes specific occupations, whereas it doesn’t support the minimum requirements for advertising in terms of other roles.

Academics

Applicants must submit a minimum of one post-graduation degree with maximum paid work experience in teaching or as an employee in a university or college. If these specific professions can meet the essential eligibility criteria, they will have the chance to gain Canadian work experience without employers requiring an LMIA. The U.S citizens and those from St. Pierre et Miquelon or Greenland can carry out the work permit application process at the Canadian port of entry.

Agriculture

Primary Agriculture Field workers can use the Agriculture program as this program permits the TFWs to gain Canadian work experience in a nursery, farm, or greenhouse. Companies will have the chance to easily hire foreign workers in the above fields due to ESDC’s initiative of suspending the minimum advertising requirements. The suspension will take place between January 12 to June 30, 2023. However, these agricultural positions will belong to lower-wage individuals and NOC categories. Therefore, hiring them will significantly impact permanent residence prospects.

Caregivers

The Temporary Foreign Worker Program allows families to hire caregivers for children above 18 years old. Additionally, people with excess medical requirements, such as elderly people above 65 years, disabled people, or those suffering from chronic diseases. The occupations aligning with the caregiver category include household support workers, personal care attendants, live-in caregivers, and nurses. Such workers are liable to provide care full-time and work at a private household where such care is provided to people. They will also need to meet the essential IRCC and ESDC.
