How to sponsor a spouse to Canada?
The Government of Canada offers the facility to sponsor common-law partners, conjugal partners, spouses of Canadian citizens, and permanent residents.
The Canadian Government allows sponsorship of spouses who have engaged in an in-person marriage, as virtual marriages are not supported.
The eligibility criteria to sponsor a common-law partner or spouse require the applicant to show the Canadian Government that they have lived together for a minimum period of a year.
Whereas the eligibility criteria for Conjugal Partner require to demonstrate to the Canadian Government that they are residing outside Canada and both of them are in a relationship for a minimum time of 1 year.
A conjugal partner who already lives in Canada cannot be sponsored, thus the applicant needs to demonstrate to the Canadian Government that there exist social and legal hindrances which are stopping from getting engaged.
The sponsored partner and the Canadian partner need to qualify certain eligibility criteria which will allow them to enter Canada.
The eligibility criteria for the sponsor require him/her to be at least 18 years and should possess a status of either Permanent Resident of Canada/ Citizen of Canada/Indian Status.
They also need to convince the Canadian Government that they are well financially sound and do not require any financial assistance.
The Canadian Government allows its citizens to sponsor their spouses who reside external to Canada but they need to assure the IRCC of their intention of returning to their native country.
While a Canadian permanent resident can sponsor their spouse residing inside Canada only after qualifying for certain eligibility criteria.
Background Check
The IRCC will conduct a background and a security check to confirm that the sponsored partner is potentially admissible in Canada.
Any applicant who possesses any sort of criminal conviction will not be allowed to enter the country, although there are various ways available to overcome criminal inadmissibility.
The Canadian Government believes in reuniting loved ones and admitting genuine couples into the country rather than the ones who try to portray a fake relationship only for the sake of Canadian immigration. Thus, the application will undergo an analysis to discover if the relationship both of them share is genuine or not.
Once the IRCC approves a couple of all background checks, the couple can then submit their application to the Government of Canada.
The ideal processing time of the IRCC to process Spousal Sponsorship is a year but the actual processing time may differ.
The IRCC has facilitated its Spousal Sponsorship clients to track their applications online.
