The process to invite family as an international students in Canada

Any student who migrates to Canada will certainly face the situation of missing their family and not being able to visit them in case of need, on special occasions, etc.

The Canadian Government understands this problem being faced by a majority of international students, which is why it has allowed students to bring their families while they are studying.

common-law partner or Spouse

Students willing to bring along their spouses to Canada need to submit an open work permit. The spouse or common-law partner should either apply for a full-time or part-time job under a Canadian employer which would also exempt them from taking an LMIA assessment.

The spouse of the student would become simultaneously eligible for an open work permit, once the student is granted a PGWP after the completion of their study program.

Dependent children

Any parent studying in Canada can bring along their dependent children to Canada on their study permit. Any child who has been financially dependent on their biological parents before attaining the age of 22 years because of reasons like physical or mental inability is to be claimed as a dependent child.  

The length of the stay of the dependent child will be equivalent to the length of their parent’s duration of the study permit in Canada.  

Canadian School System   

Canada’s education system has been designed exceptionally well as it abides every child to attend school by its law. This includes children of both temporary and permanent residents.   

The schooling pattern of Canada starts by studying in elementary classes and then proceeding to high school. The education system of Canada offers a total of 12 grades, each for one year at the school, in which a student has to start by studying in grade 1 till grade 12.   

How is the Study Permit application affected?  

The probability of getting the study permit application rejected is increased in the case of coming along with the family during the study permit. As this indicates to the Canadian Government that the applicant is more concerned about their family instead of the study program.   

Although if the applicant still needs to take their family along with them, he/she should take assistance from a legal Canadian lawyer.   

How to stay in Canada after completion of the study program?  

The chances of obtaining a Canadian permanent residency increase to a greater extent for an international student studying in Canada as it opens the door to various immigration programs.   

The applicant and their partner’s work experience, language skills in English or French, and educational qualifications can contribute to qualifying the eligibility criteria for various immigration programs.   

If a student decides to permanently reside in Canada, then he/she must continue their stay by applying for the federal Express Entry. Under this pool, every candidate is provided with a CRS score which is extracted after the application is evaluated on various components.   

The higher the total CRS score, the higher will be the chances of the applicant obtaining a Canadian Permanent Residency. And the chances of getting the Canadian Permanent Residency can be further increased if the applicant applies with their spouse.   

For example– if the applicant’s partner has been residing in Canada for work purposes while he/she is still enrolled in a study program, their inclusion of them can raise the chances of getting a Canadian Permanent Residency.   

Spouses can enter the Express Entry pool on behalf of the applicant, which would help in adding credibility to the application of the applicant because of their work experience.
